1 in 5 Landlord Break the Law on Deposits
If you have an Assured Shorthold Tenancy (AST), your landlord is expected to follow specific rules when handling your deposit. These are three of the most common ways landlords get it wrong.
Deposit Not Protected
Your deposit must be held in one of three government-backed schemes: DPS, TDS, or MyDeposits. Keeping it in a personal bank account is illegal.
Your landlord should register your deposit within 30 days of receiving it. If this hasn’t been done, you may be eligible for compensation of up to 1–3× your deposit.
High Cleaning Charges
“Professional cleaning” is one of the most common excuses used to deduct from deposits. 67% of tenants in our data were charged £550+ just for cleaning.
Lack of Evidence
“Damage” is one of the most common reasons landlords use to deduct from deposits. Charges are often applied without clear supporting evidence.
If your deposit hasn’t been protected properly, you may be eligible for compensation of up to 1–3× your deposit, in addition to the deposit itself.
Example: a £1,500 deposit could lead to up to £4,500 in compensation.
